Acting on the administrative complaint dated April 21, 2003 of complainant Alfredo B. Juarez, Sr. against the Clerk of Court of this Court’s Second Division for undue partiality, obvious obstruction of justice constitutive of conduct unbecoming of an officer of the Supreme Court, the Court resolves to DISMISS the same for utter lack of merit. Complainant is INFORMED that the resolutions subject of his administrative complaint which are signed by the Division Clerk of Court are merely reproductions of the actions taken by the Court after deliberations as reflected in the minutes of its proceedings.
Complainant’s letter dated 31 March 2003 protesting against the “undue partiality and obstruction of justice unbecoming a high official of the Honorable Supreme Court” allegedly committed by the Clerk of Court of the Second Division, referred by 1st Indorsement dated 1 April 2003 of the Office of the Chief Justice, and complainant’s letter dated 2 June 2003 following-up his administrative complaint against the Clerk of Court of this Division and inquiring about the status of OMB-1-01-1122-K and OMB-1-01-1123-K relative to the administrative charges against respondent, which were referred to the Office of the Court Administrator by the Office of the Deputy Ombudsman for Luzon, referred by 2nd Indorsement dated 18 June 2003 of the Office of the Chief Justice, are NOTED.
