IMAM vs. COMELEC

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 17 2004.

G.R. No. 161860 (Nasser P. Imam vs. Commission on Elections and Kahir M. Macapeges.)

Acting on the Special Civil Action for Certiorari and Prohibition with Prayer for Temporary Restraining Order and/or Writ of Preliminary Injunction, the Court Resolved to require the respondents to (a) COMMENT thereon within ten (10) days from notice hereof; and (b) observe the STATUS QUO prevailing before the filing of the petition.

The Court further Resolved to NOTE the

(a) Additional Arguments in Support of the Prayer for Issuance of a Temporary Restraining Order and/or Writ of Preliminary Injunction dated 16 February 2004 filed by counsel for petitioner; and

(b) Opposition to Issuance of Temporary Restraining Order and for Submission of the Minutes of the Proceedings Before the Board of Canvassers dated 16 February 2004 filed by counsel for private respondent Kahir M. Macapeges.
